These Terms of Service (“Terms”) govern your access to and use of the services provided by Mochi L.L.C-FZ (“Mochi,” “we,” “our,” or “us”), a company incorporated under the laws of the United Arab Emirates, Meydan Free Zone. By using Mochi’s services, you agree to be bound by these Terms.


If you do not agree to these Terms, you must not use Mochi.

1. Eligibility

  • You must be at least 18 years old to use the Services.

  • You may use Mochi as an individual or on behalf of a business or team.

  • By using Mochi, you represent and warrant that you have the authority to enter into these Terms.




2. Services


Mochi provides a customer relationship management (CRM) and AI platform designed to help coaches and teams:

  • Manage direct messages across supported platforms (including integrations with Meta APIs).

  • Track leads, conversations, and bookings.

  • Integrate with third-party services (such as payment processors and analytics providers).

Mochi continuously evolves and may introduce new features, integrations, or services.




3. Subscriptions, Payments & Refunds


  • Mochi is provided on a subscription basis, billed through Stripe or other approved payment providers.

  • Fees are due in advance of the subscription period.

  • Users are eligible for a 7-day refund from the date of first payment.

  • If you cancel, any unused portion of your subscription will be refunded pro rata.

  • All payments must be valid, authorized, and free from fraudulent activity.




4. Acceptable Use


You agree not to use Mochi in any way that violates applicable laws, Meta Platform Policies, or these Terms, including but not limited to:

  • No spam or unsolicited communications.

  • No abusive, threatening, or harassing content.

  • No sexually explicit, hateful, or illegal material.

  • No deceptive or misleading offers.

  • No misuse of integrations (including Meta APIs) for purposes not permitted under Meta’s rules.

  • No impersonation without authorization. If using voice or content reproduction, you must have all necessary rights and permissions.

Mochi reserves the right to suspend or terminate any account found to be in violation of these obligations.




5. User Responsibilities


  • You are responsible for ensuring that your use of Mochi complies with all applicable laws and third-party platform policies.

  • You are solely responsible for the outcomes of your business activities, including conversion rates, revenue, or lead generation. Mochi provides tools, but does not guarantee results.




6. Third-Party Services


Mochi may integrate with third-party platforms and services, including but not limited to Meta (Instagram, Facebook), Stripe, Google Cloud, and analytics providers.

  • Mochi is not responsible for interruptions, errors, or failures of third-party services.

  • Use of third-party services is subject to their own terms and policies.




7. Availability & Service Interruptions


  • We aim to provide reliable and continuous service but do not guarantee 100% uptime.

  • Mochi is not liable for downtime, data loss, delays, or errors caused by internet providers, hosting partners, or third-party services.




8. Termination & Suspension


We reserve the right to suspend or terminate your account at our sole discretion if:

  • You violate these Terms or our Privacy Policy.

  • You engage in unlawful, harmful, or abusive conduct.

  • You fail to pay subscription fees when due.

Upon termination, your access to Mochi will end immediately, and your data may be deleted in accordance with our Privacy Policy.



9. Limitation of Liability


  • Mochi is provided on an “as is” and “as available” basis.

  • To the fullest extent permitted by law, Mochi disclaims liability for indirect, incidental, or consequential damages, including lost profits, business interruption, or data loss.

  • Mochi’s total liability under these Terms will not exceed the fees paid by you in the twelve (12) months preceding the claim.




10. Governing Law & Dispute Resolution


  • These Terms are governed by the laws of the United Arab Emirates (Meydan Free Zone).

  • For the purposes of business verification or regulatory requirements, Mochi may elect to recognize jurisdiction in the United States if required by Meta or other regulatory authorities.

  • Any disputes shall first be resolved through good faith negotiation and mediation.

  • If unresolved, disputes may be submitted to the courts of Dubai, UAE or, where applicable, competent courts in the United States.




11. Changes to Terms


We may update these Terms from time to time. If changes are material, we will notify users through the Services or by email. Continued use of the Services constitutes acceptance of the updated Terms.
